General terms and conditions

Scope of application

Our General Terms and Conditions apply exclusively to all services offered. These include all activities of Breathatelier (Switzerland), such as teacher trainings, workshops, yoga holidays/retreats, events etc. and/or not mentioned contract conclusions, which are in connection with mentioned business activities.

Should individual provisions be or become invalid, the remaining provisions shall remain valid. The ineffective regulation will be replaced by the legal regulation. By placing an order/registration and participating in the course or retreat, the practitioner/course participant declares his/her agreement with our terms and conditions. Deviating conditions require our written consent.

Likewise, my terms and conditions apply in full and in addition/differently for courses abroad or yoga holidays/retreats.

Insurance / Liability claims

Insurance is the responsibility of the course participant. The courses, retreats and events are held to the best of our knowledge and belief. It is the responsibility of the course participant to find the right measure for his/her own body during the courses and retreats. Whether a participation in the courses and retreats is compatible with the respective physical and mental condition, each participant has to check and decide for himself/herself with his/her own responsibility or after consultation with the family doctor. The organizer and course instructor disclaims all responsibility and liability for any ailments or injuries of any kind that occur in connection with attending yoga classes.

Injuries or previous medical conditions must be reported to the course instructor in advance.

Liability

No liability will be accepted for lost or stolen valuables.

In case of pregnancy

Before enrolling in the course, please consult with your doctor to determine if a yoga class is suitable. Participation is at your own risk. The course instructor must be informed in any case before the start of the course.

Execution of courses and events

Group courses are held with a minimum of 3 participants. If a course has to be cancelled by the course management, this will be communicated immediately. If the participant has already paid for the course, he/she can use the credit for another course.

Registration and booking (workshops, retreats and regular classes)

Registration is done via e-mail/homepage to: info@breathatelier.com. After I have received the registration, I will send the participants an e-mail confirmation with the invoice and bank details for the payment of the training/workshop/retreats. The payment date listed there is binding. The registration is binding and obligates to the payment of the vacation money. Non-payment of the vacation fee is not considered a cancellation. If the number of participants is limited, registrations will be considered in the order in which they are received. The date of receipt of the bank transfer is decisive.

Withdrawal, cancellation, no-show

Any registration (training, course, workshop, special classes, retreat) by mail is considered binding. After final registration, the following cancellation conditions apply.

Regular courses according to the timetable:

In case of cancellation up to 24h before the course starts, the course fee will not be charged/refunded. Cancellations within 24 hours before the start of the course will be charged at 100%. In case of no-show, the outstanding amount will be charged or deducted from the subscription.

Teacher Training / Retreats:

A demanded deposit for trainings / retreats abroad is due upon registration (unless otherwise agreed). This amount is non-refundable in case of cancellation. The total balance must be paid no later than 30 days prior to departure.

If payment is not made by the due date, Breathatelier may refuse to provide services and may enforce cancellation charges.

The balance is refundable as follows:

The balance is refundable up to the due date (see date in the announcement). After that, or 2 months before the start of the training / retreat, no refund is possible, the costs will be charged at 100%.

For services that have to be booked externally and on your own responsibility (example: transportation, hotel rooms, meals, massages, excursions, lessons etc.), the cancellation conditions of the provider apply. The organizers of the retreat assume no liability for these services.

Travel insurance

Insurance is the responsibility of the participant in all respects. We advise each participant to take out the following insurances: Travel cancellation insurance, health insurance and accident insurance.

Cancellation conditions / cancellation fees

The reservation is definite and binding from the moment of booking. In the event of cancellation, no refund will be made. The participant has the possibility to name a substitute participant. This must be done at the same time as the cancellation. A handling fee of CHF 100.- will be charged as well as any rebooking costs. It is the participant’s responsibility to take out travel cancellation insurance and international health insurance.

Covid measures

For the participation in workshops, yoga classes and retreats, the current regulations, which are decreed by the responsible Government / BAG in Switzerland at the time of the event (yoga class, workshop, retreat), always apply. Breathatelier does not assume any responsibility for changes in participation regulations at short notice. It is the responsibility of the participant to take out travel cancellation insurance.

Entry formalities for retreats abroad

Passport or identity card, must be valid at least until the return date. Citizens of other countries are advised to check with the consulate or embassy of the country of entry for entry formalities. I recommend ensuring that the passport is valid for at least 6 months beyond the return date. Compliance with entry requirements is the responsibility of the client. Breathatelier accepts no liability for non-compliance and associated expenses, e.g. in case of denied entry. I kindly ask you to inform yourself about any changes in the regulations until your departure.

Travel insurance for retreats at home and abroad

Insurance is the responsibility of the participant in all respects. Breathatelier advises each participant to take out the following insurances: Travel Cancellation Insurance, Health Insurance and Accident Insurance.

Personal and health requirements

Good health and a stable mental condition are required for the trips. The participant is responsible for his/her own participation and is obliged to inform the course management of any physical and/or mental impairments. If necessary, he/she will seek the advice of an appropriate doctor or psychotherapist before participating. If a participant does not meet the physical or psychological requirements, the tour guide can exclude the participant from the tour or further travel. Return travel costs, etc. are the responsibility of the participant and the paid travel price cannot be refunded.

Payment methods

The prices stated at the time of registration/order are valid.

Payment methods available are bank transfer or electronic payment with Twint, Wise or Paypal. Twint payment can be paid in full in advance or at the latest before the start of the course/event.

In the case of bank transfer, the amount is to be paid within 10 days in advance to the bank account indicated.

Only in case of no-show Breathatelier is entitled to issue an invoice.

Privacy policy

The data and personal details collected during the registration process are used exclusively for the purpose of complete order fulfillment.

Miscellaneous/ Other

Breathatelier uses photos of events on its own website or on social media where participants can be recognised. Should this happen against the will of a person, he/she can request Breathatelier to remove his/her person on the picture. Further and own claims cannot be asserted.

Changes to these terms and conditions

Breathatelier reserves the right to modify these terms and conditions over time. The current version of the general terms and conditions will always be published on the website www.breathatelier.com/agb

Jurisdiction and applicable law

The legal relationships are exclusively subject to Swiss law. The exclusive place of jurisdiction for all disputes arising from or in connection with these General Terms and Conditions is the place of residence of Anita Jetzer (3095 Spiegel bei Bern).
